NEW DELHI:The Supreme Court today quashed the Chhattisgarh Private Universities Act and declared as null and void over 100 private universities started under this act. The SC also termed the law that permitted private universities as ‘unconstitutional’.
Allowing an appeal filed by educationist Yashpal, a bench headed by Chief Justice R C Lahoti quashed the Chhattisgarh Private Universities establishment ordinance.
"The Supreme Court heard all the petitions and decided that section 5 and 6 of the Chhattisgarh Act is ultra vires under the constitution and will be struck down. The universities therefore will cease to exist."
"Whichever government is in power it is their duty to make sure that the students in these institutions do not suffer. Our government will make sure of that," said Ajay
Chandrakar, Education Minister, Chhattisgarh.
The law permitting private universities in Chhattisgarh was passed when Ajit Jogi was the Chief Minister of the state.
The court said all the private universities established in the state under the law would cease to exist.
If these universities established any institution, then steps will be taken to affiliate them to existing varsities in the state, the apex court added.
